Homeschooling Kindergarten in Virginia: A Simple Compliance Checklist

If your child turns five on or before September 30, you are officially a "school-age" family in Virginia.
Here is what you need to know to remain compliant while keeping your summer stress-free:
1. File a Notice of Intent (NOI)
Virginia law requires all children between ages 5 and 18 to receive an education. By August 15, you must submit an NOI to your local superintendent. This letter informs the district that you are providing home instruction and should include:
- A description of your curriculum, which really is just a simple list of subjects (e.g., Math, Language Arts, and Science).
- Evidence of qualification: Such as a high school diploma.
2. No "Proof of Progress" Required
Under Virginia Code § 22.1-254.1(C), the requirement to provide evidence of academic progress (testing or evaluation) does not apply to children who are under age 6 as of September 30.
3. The Kindergarten Delay Option
If you feel your child is not yet ready for formal schooling, you may notify your school board in writing that you wish to delay attendance for one year. If you choose this "opt-out" path, you do not need to file an NOI until your child turns 6.
Summary Checklist for Age 5 (by Sept 30):
- File NOI: Due by August 15.
- Curriculum List: Include this with your NOI.
- Relax: No testing or professional evaluations are due this August.
